MESSAGE: Please oppose the Dept. of Education’s Regulations revising provisions relating to a safe and respectful learning environment. The vast majority of parents and taxpayers oppose this horrendous policy which will destroy the privacy and safety of our children. The policy requires open restrooms, locker rooms and hotel rooms on overnight field trips to members of the opposite sex if they feel they are transgender. It mandates that students, faculty, and volunteers use gender diverse pronouns chosen by the gender diverse individual. It calls for punishment for those who do not comply. It bullies students by forcing them to endure gender diversity curriculum, teaching that gender is not a matter of biology but “assigned at birth” or changes on a whim. This policy ignores the rights of the overwhelming majority of students including their right to privacy. It mandates the teaching and acceptance of gender diversity ideology undermining the chosen values of parents and students.

Testimony of Janine Hansen, President, and Lynn Chapman Vice-President Nevada Families
To: Legislative Commission: Assemblymen Frierson, Benitez-Thompson, Carlton, Oscarson, Pickard, Wheeler, Senators Atkinson, Denis, Farley, Ford, Hammond, Kieckhefer
Regarding: Dept. of Education Policy implementation of SB225, the so-called Anti-Bullying bill, which has now become a Transgender “rights’ policy, bullying all other students, taking away their rights.
The proposed regulations violate the First Amendment which prohibits an establishment of religion. The Dept. of Education is establishing a secular religion through government force which focuses on transgenders ideology and “rights’ to the exclusion of the rights of all others.
The regulations violate the First Amendment which requires that the free exercise of religion be protected. It takes away the free exercise of students by forcing students to share bathrooms, locker rooms, showers and overnight accommodations with persons who are biological of the opposite sex. This will violate many students’ religious beliefs in modesty and virtuous behavior. It mandates the teaching and acceptance of gender diversity ideology undermining the chosen values of many parents and students.
The Ordinance of the Nevada Constitution requires “that perfect toleration of religious sentiment shall be secured, and no inhabitant of said state shall ever be molested, in person or property…” This proposed regulation violates the requirement of “perfect toleration” for students and parents who may object to the transgender ideology/religion being promoted in the classroom and being enforced by punishment. This policy quite literally subjects students to possible molestation. Just the mere presence of an unclothed biological male in the girl’s shower room constitutes sexual molestation because it will be offensive and threatening.
The First Amendment of the Constitution prohibits abridging the freedom of speech. In addition, Article 1 Section 9 of the Nevada Constitution states, “Every citizen may freely speak, write and publish his sentiments on all subjects being responsible for the abuse of that right; and no law shall be passed to restrain or abridge the liberty of speech…” This regulation forces students, faculty, and volunteers to use made-up pronouns when referring to a transgender. In addition, it requires punishment of those who fail to use these made-up pronouns. This violates the First Amendment and the Nevada Constitution which prohibits the abridgment of speech. This will create an atmosphere of transgender tyranny as punishment is meted out in the classroom to those who either by accident or religious preference fail to use these arbitrary pronouns which violate the common and accepted usage of the English language.
The regulations violate the Right to Privacy identified by the U.S. Supreme Court. This regulation subjects students to sharing bathrooms, locker rooms, showers, and overnight accommodations with persons who are biologically of the opposite sex, violating the students’ rights to privacy. It also jeopardizes their physical safety creating danger, especially for girls.
The vast majority of parents and taxpayers oppose this horrendous policy which will destroy the privacy and safety of our children. Please vote against the adoption of these regulations.
